Theater shooting suspect James Holmes appears dazed in court

CENTENNIAL, Colo.--James Holmes, the suspect in the Colorado theater massacre, appeared in a Colorado courtroom on Monday, three days after one of the deadliest shooting sprees in modern American history.

Arapahoe County District Court Judge William B. Sylvester advised Holmes of his Miranda rights, and said that there was probable cause to continue to hold him without bond on suspicion of first-degree murder.

Holmes, who was transported from a holding cell to the courtroom via an underground tunnel, appeared dazed. His brow furrowed. His head bobbed. His eyes opened and closed often. His hair was dyed a cartoonish orange-red. His hands and feet were shackled. He did not speak.

Seated in a jury box next to Tamara Brady, a public defender, Holmes never looked in the direction of a gallery that included victims and their advocates. Two sheriff's deputies stood watch nearby.

His demeanor, however, angered the relatives of some of the victims of the shooting. Some stared at him the entire hearing, including Tom Teves, whose son, Alex, was killed in the attack. Teves watched Holmes intently, sizing him up.

"I saw the coward in court today and Alex could have wiped the floor with him without breaking a sweat," said Teves, whose son, a physical therapist, dove to protect his girlfriend.

"You shot a 6-year-old. Come on give me a break. You're dressed in full combat gear, immediately surrender. Come on. Pick on some guys who know how to use guns," Teves told the AP.

The preliminary hearing lasted about 11 minutes. Holmes' next court appearance is July 30, when he is expected to be charged.

A decision on whether to seek the death penalty could be weeks or months away, District Attorney Carol Chambers told reporters as she entered the courthouse.

"It will be a conversation we have with the victims before we make that decision," Chambers said.

Holmes could also face additional counts of aggravated assault and weapons violations stemming from the mass shooting that killed 12 and injured 58 people at an Aurora, Colo., screening of "Dark Knight Rises."

Clad in full body armor, he surrendered to officers in a parking lot behind the cinema. Holmes did not resist arrest, but investigators have since described the former PhD student at the Univ. of Colorado-Denver medical school as uncooperative.

Authorities and news reports have portrayed the native Californian as smart and shy, but no motive for the shooting spree has surfaced.

Federal investigators were dispatched to assist local authorities with the investigation, but officials have indicated justice will be sought in a state courtroom.

Colorado has a death penalty, but only one inmate has been executed since 1977. Three inmates are currently on death row, according to the Death Penalty Information Center.

"If James Holmes isn't executed," former Denver prosecutor Craig Silverman told Reuters, "Colorado may as well throw away its death penalty law."

Despite the fact that Holmes was arrested with weapons on him?and his apartment found "booby-trapped"?Chambers said investigators are still diligently pursuing more evidence.

"I would say there's no such thing as a slam dunk case," she said during a press conference outside the courthouse. "It is a case where we are still looking at the enormous amount of evidence."

The district attorney, who admitted she was seeing the defendant for the first time, was asked if Holmes might have been on medication at the hearing.

"We have no information about that," Chambers said.

At a news conference in San Diego, where Holmes' family lives, their lawyer, Lisa Damiani, refused to answer questions about him and his relationship to the family. She said later: "Everyone's concerned" about the possibility of the death penalty.

When asked if they stood by Holmes, Damiani said, "Yes they do. He's their son."

All 110 seats in the courtroom were full for the hearing, with some 80 or so occupied by victims, their families or counsellors recruited from local police departments to help those grieving. A few of the victims, some of the wearing dark sunglasses, embraced in long hugs before taking their seats.

Jessica Watts was in the court to represent her cousin, Jon Blunk, who was fatally shot in the theater after pushing his girlfriend out of harm's way.

Watts said she held back her emotions when the alleged killer was ushered in.

"I tried not to have a reaction because I wanted the focus to be about Johnny," she said. "There's so many emotions that I have for him."

Ramon Zabriskie and Neil Lundberg surveyed fathers and youth from more than 600 U.S. households of varying backgrounds for the study, with each family having at least one youth between the ages of 11 and 15.

?Too often when people think about family leisure, they think of the time they spend on vacations and neglect the leisure time spent at home,? Buswell said. ?Family vacations and other balance activities can only help build a family if there is a foundation to build upon first.?

?When fathers invest time in low-cost, home-based, spontaneous activities close to or in the home, youth notice the difference,? Zabriskie said. ?It doesn?t have to be something big. In fact, our research shows the little activities are the most important.?

The researchers looked at two types of family leisure: core activities and balance activities. Core family leisure is defined as doing activities that require little planning and little money, such as:

• Eating a meal together
• Playing board games
• Watching TV and movies
• Playing sports in the yard/park
• Playing video games
• Attending children?s performances
• Gardening
• Reading books

Balance leisure activities are those that take more time, planning and money, such as family trips.

The researchers found that the core activities contribute more to youth?s perception of family functionality and family cohesion than the balance activities. Of course, balance activities also had a positive effect.

?We spend so much effort on the big-ticket items thinking that it?s the most important thing for our families, when really, more time with our kids on day-to-day activities will suffice,? Lundberg said.

Studies have found links among father involvement and aspects of family functioning, but this study, published in a recent issue of Leisure Sciences, is among the first to examine that relationship on a broad scale with a large sample of families.

Surveyed families came from every major U.S. region and had annual incomes ranging from less than $10,000 to more than $150,000.

Lydia Buswell, then a graduate student in the Recreation Management program, was the lead author on the study. Alan Hawkins, a professor in the BYU School of Family Life, was also a coauthor.

Write and lose weight!

Prompt of the Week: Write about something red.

Have you heard the good news? Writing helps you lose weight!

This isn?t my claim: it?s Julia Cameron?s, author of the ?The Artist?s Way.? In sum (because I only have about 600 words to work with here), it?s a mix of her popular morning pages exercise (three pages of stream of consciousness writing in the a.m.) in conjunction with keeping a food journal.

Statistics have proved for years that keeping a food journal is a key element to success when it comes to weight loss. Why? Because attention leads to awareness. Goal setting is infinitely more effective if you write down your goals instead of keeping them as a thought floating around in your head. Putting pen to paper makes it concrete; it makes it real. It?s almost like giving your brain directions for what to do next. It?s a map, so to speak. And once it?s there in black and white, something you can see at any time (because you?re going to put it somewhere visible), you?ll find that things start to move forward.

So if creative writing isn?t your thing (yet), consider putting a few goals onto paper this week. No need to come up with a bucket list of everything you want to do in life; you don?t have to draft your mid-year resolutions. Just choose one or two things that you?d really really like to do/be/have. Write it down and put it everywhere (front door, bathroom room, fridge, above the toilet, car dashboard). Then fuhgettaboutit. Read it when you see it and go on with your day. If you notice something happening that moves you in the direction of your goal, jot that down. Keep a list of any ?evidence? or proof, no matter how small. As you begin to notice the small things, bigger things will begin to happen. I wish I could explain it better, but I can?t. I just know it works.

You might picture Neanderthals as cavemen gnawing on bones around a campfire. Which wouldn't be inaccurate. But Neanderthals may have also dined on roasted vegetables and known a bit about medicinal plants too. So says a study in the journal Naturwissenschaften (The Science of Nature). [Karen Hardy et al, Neanderthal medics? Evidence for food, cooking, and medicinal plants entrapped in dental calculus (link forthcoming)]

Researchers analyzed hardened dental plaque from five Neanderthals found in El Sidr?n cave, in northern Spain. Yes, 50,000-year-old dental plaque. And they found a lot lurking between the teeth. Like evidence of nuts, grasses and green veggies, chemical traces of wood smoke, and tiny, intact starch granules, proof Neanderthals ate their carbs.

And in one individual, they detected compounds found in the medicinal herbs chamomile and yarrow. The herbs have no nutritional value, and since Neanderthals did have the gene to detect the herbs' bitter taste, the researchers speculate that the cave dwellers were munching on them not as food?but to self-medicate. Not too far-fetched, they say, because primates like chimps also use medicinal plants.

Luckily for the scientists doing this detective work, Neanderthals may have known a thing or two about medicine, but they didn't get regular check-ups at the dentist.

Hundreds of Florida Teenagers Storm Walmart in Criminal Flash Mob

A Jacksonville, Florida party went a bit too wild this week after hundreds of teenagers relocated their shindig to a local Walmart store and went on a rampage, all the while videotaping their outrageous escapades.

Police investigating the Saturday night stampeding of the north Florida store say that around 300 youths were involved in the melee, which miraculously didn't directly spawn any serious injuries. Moments before storming the store, however, one 20-year-old party-goer reported being shot in the leg while leaving the original get-together.

The entire incident began at what a neighbor tells the Florida Times-Union was a "massive crowd party" in a subdivision in Jacksonville that attracted noise complaints from neighbors. When the police responded to the scene, attendees regrouped around two miles down the road to Walmart.

In the aftermath, police say that only snacks and soda were stolen and that minimal damage and no injuries were reported at the Walmart, although a $1,500 store security scanner is believed to have been broken during the event. Cell-phone footage recorded at the scene of the crime shows several hundred youths clearly causing a disturbance in the store, taking watermelons out of produce containers and generally making mischief throughout the front of the store. Gun shots were also reportedly fired outside of the store but no one was hit.

"The actions of these teenagers was deplorable and put at risk the safety of innocent bystanders, staff and customers," Walmart spokeswoman Dianna Gee tells the Florida Times-Union. "We are committed to assisting law enforcement in any way we can to identify the people responsible for the commotion, including acts of vandalism and thefts at the store."

Police are already drawing comparisons to a similar incident last year outside of Washington, D.C. that involved a gang of unruly youths storming a 7-11 and causing coordinated mischief only momentarily before leaving the store. Such spontaneous gatherings have been considered "flash mobs" in the past, but with a new rash of events involving theft and destruction, police have a new phrase: flash-robs.

"America's toughest" sheriff on trial over discrimination claims

PHOENIX (Reuters) - Arizona lawman Joe Arpaio, who calls himself America's toughest sheriff, was accused of racial profiling as a trial began on Thursday in a class-action lawsuit alleging he discriminated against Latinos in his crackdown on illegal immigration.

The case will test whether the Maricopa County Sheriff's Office can target those in the country illegally in immigration sweeps without racially profiling Hispanic citizens and legal residents.

The 80-year-old Arpaio, who is seeking re-election to a sixth term in November, has been a lightning rod for controversy over his aggressive enforcement of tough immigration laws in the border state with Mexico and his volunteer posse's investigation into the validity of President Barack Obama's birth certificate.

Arpaio was not in court on Thursday when lawyers for both sides in the class-action suit made opening statements before Judge Murray Snow in the non-jury bench trial at U.S. District Court in Phoenix.

"A fundamental value of our nation is equal protection under laws, regardless of race or ethnicity," plaintiff attorney Stanley Young said.

He added he would argue that Arpaio's office had "engaged in racial discrimination," and particularly cited his immigration sweeps, or "saturation patrols."

Tim Casey, a lawyer for Arpaio and the sheriff's office, said his side would prove there was no such profiling as alleged by the five plaintiffs in the lawsuit nor was there discrimination by the office in three stops cited in the suit.

"We have five plaintiffs on three stops. The evidence will show race and ethnicity had nothing to do with their traffic stops," he said.

The trial focuses attention again on Arizona, which claimed headlines last month when the U.S. Supreme Court upheld a key element of the state's crackdown on illegal immigrants requiring police to investigate those they stop and suspect of being in the country illegally.

Supporters said the law was needed because the U.S. federal government had failed to secure the porous Southwest border with Mexico. Obama's administration challenged it in court, saying the U.S. Constitution gives the federal government sole authority over immigration policy.

Arpaio faces a separate, broader lawsuit lodged by the U.S. Justice Department in May, alleging systematic profiling, sloppy and indifferent police work and a disregard for minority rights by him and county officials.

Protesters from both sides of the debate gathered outside the court from early morning toting flags and placards. One read, "Sheriff Joe does immigration sweeps, makes drug busts, what more do you want?"

"No to hate, no to fear" and "God forgive Arpaio," read others.

EXPERT WITNESS

Lawyers for the plaintiffs called Ralph Taylor, a criminal justice expert at Temple University in Philadelphia, who analyzed racial and ethnic patterns from traffic stops carried out by the office from 2007 to 2009, including about a dozen "saturation patrols" in the Phoenix valley.

Taylor told the court that when an officer ran a name check on the day of a major sweep, there was "a much higher likelihood" the name run would be Hispanic than non-Hispanic. He also testified that when an officer ran a check of at least one Hispanic name, the stop would take about two minutes longer.

During cross-examination, the defense called Taylor's study biased, arguing it failed to take into account variables including language difficulties that might lengthen stops involving Hispanics, and did not draw on complete data sets.

David Vasquez, 47, testified he was stopped by sheriff's officers in June 2008 during a sweep, ostensibly because he had a cracked windshield. The officer asked Vasquez if he spoke English and checked his driver's license and other documents, but did not cite him.

"I just found it funny that he asked me if I spoke English ... because I felt that I was being singled out," Vasquez said in testifying for the plaintiffs, adding he later told his wife he believed he was "pulled over for ?driving while brown.'"

The five plaintiffs in the suit are Hispanics stopped by deputies and the Somos America immigrants' rights coalition. It was later expanded to include all Latino drivers stopped by the office since 2007.

The lawsuit was brought in the name of Mexican tourist Manuel Ortega Melendres, who was a passenger in a vehicle pulled over by deputies in 2007, ostensibly for speeding. Melendres was arrested, despite having a valid visa and producing identification, while the vehicle's white driver was neither cited nor taken into custody.

The defense counsel asked the deputy who stopped the vehicle, Louis DiPietro, if he relied on skin color in a decision to detain anyone, to which he replied, "No."
